The EvillaMotorsports and its affiliates make no expressed or implied representations or warranties, of any kind with respect to the content, operation, information, or materials contained therein. You agree that EvillaMotorsports, its officers, directors, employees or other representatives are not liable for damages arising from the content, use or the operation of the EvillaMotorsports.com web site or purchased products. You are giving consent that this limitation of liability is inclusive and applies to all types of damages, including indirect, without limitation direct, compensatory, incidental, special, punitive and consequential damages.
EvillaMotorsports.com and its affiliates reserve the right to make changes to this web- site and these terms and conditions at any time.

Conditions of Use

Exchanges / Replacements: ALL returns shipping fees need to be prepaid. We do not accept COD returns. (This is part of the risk the buyer should encounter with most mail order type business) Shipping Fees are not reimbursed.

  • For replacements or exchanges, we must first receive the merchandise. We need to examine the defective merchandise.
  • ALL items that are returned to us need to obtain Return Authorization issued by us. The Authorization is valid for 7 days from the date of issue. Please contact us to request return instructions and an Authorization number.
  • Exchanges are acceptable only for defective items within 30 days of purchase. It is offered after professional installation help has been requested. Defective items can be returned for replacement conditioned on the all of below. . .

Returns and Warranties restrictions and the following:

  • Merchandise should be returned with its original packaging, documentation, etc.
  • Special Order merchandise will NOT be canceled, exchanged or returned.
  • Merchandise should not be damaged during installation.
  • Returns that are defective will be subject to a $10 handling fee. All non-product charges such as transaction cost, shipping, and insurance are not refundable. If you wish the item to be returned, you are responsible for all the return shipping and handling fees.
  • A number of products may vary slightly due to lighting, picture angles, or alternate manufacturers. Most products would not be affected. You agree to these terms by performing the transaction. If you have questions, please feel free to contact us.
    Returning items that are not ours is an act of fraud. Some products contain concealed security devices that have no effect on merchandise performance or appearance.
  • If an appropriate replacement cannot be made within 3 weeks, your money will be refunded minus the cost of shipping.
  • If we make an error and ship you the incorrect item we will replace it after it has been shipped back to us. This does not happen too often. We will only ship back after receiving the item and inspecting it to make sure everything is in order. Since we have encountered people taking advantage of this situation we are now implementing stricter rules. We have seen in the past that the customer damaged items that were not ours.
  • All Return merchandise WILL be subject to a 20% restocking fee.
  • Any order which is canceled before it is shipped will be charged a 5% fee, if the order cost has not been charged no fee will apply.

RESTOCKING FEE OF 20% WILL BE APPLY TO ALL RETURNS, AND ALL RETURNING ITEMS SHOULD BE IN NEVER USED, BRAND NEW CONDITIONS; OTHERWISE THE RETURN (s) WILL BE DENIED.

NO RETURNS OR REFUNDS ARE ACCEPTED AFTER 30 DAYS OF ORDERING.

Shipping & Returns

Shipping:

In most cases, the items are shipped by UPS Ground except for Alaska, Hawaii, military bases and US territories. Shipping costs for the above exceptions may be additional and are not included in the shipping cost listed for the auction.

  • We do not ship to PO Boxes. We only ship to physical addresses, if paying by credit card, there needs to be a building address to which we can ship the item.
  • Shipments usually leave our warehouse between 2-3 business days from payment receipt. Processing payments and packaging take some time, so please be patient. However, shipments may be expedited for an additional handling fee, please call us for more information. We almost never do overnight shipping.
  • Handling fee is incorporated into the cost of shipping. Additional packing materials, boxes and labor are used to safely send out packages.
  • Multiple small products can be sent together. One small and one large items may be sent together. Two large items will ship separately. Please ask us about the items you intend to buy to find out how we will ship them. Items will not be shipped together if payments are not received together.
  • We will issue a delivery confirmation number (USPS) or tracking number (UPS) for shipments upon request. Requests may be made 5 days after payment (credit card or online payments) and 10 days if payment is mailed.
  • Refused or undeliverable shipments are not granted a refund. Returned shipments will be held until a $10 handling fee and charges to cover re-shipping are paid in full. If an address change occurs through no fault of our own, during a UPS shipment, we expect you will honor a $5 charge (charged to us by UPS).

International Shipping:

  • Your Order will be RECALCULATED and sent for your approval prior to being charged for your order.
  • The customer is responsible for all duties and customs. Shipments to Canada are shipped via USPS or UPS. We prefer UPS because it is more economical and also traceable compared to the USPS Express mail.
  • Orders outside the US (Canada is an exception) are often shipped via US Express mail with insurance and signature requirement. We are unable to provide a tracking number with a USPS surface or airmail shipment since USPS does not offer such service. If the item is damaged or lost through this route it may take up to 30 days to file a claim and under this agreement, all customers agree to settle such claim with USPS.

Shipping Issues: Under special circumstances a shipment may be delayed:

The customer is responsible for receiving the order after the shipment departs our warehouse. If the carrier puts the package at the door and if it gets lost or stolen, it is not our responsibility. If you prefer your package to be shipped as “restricted delivery”, where a signature is required, please indicate that while making your order, and we will provide this service at an additional cost for this service (usually $2-$3).

  • UPS does not require a signature to for package deliveries. They may leave a package at a door and it is considered delivered. We consider it delivered as well. The incidence of lost or stolen packages has been so rare, that it usually does not impose an issue, but we feel we need to inform you to renounce our liability in case your neighborhood or building has issues with this.
  • In the case of a lost order in transit, we will file the necessary forms to obtain a refund. As soon as we are assured we will be paid, we will reship the product. We have to wait for the payment confirmation before resending you the product as at times the package arrives to the customer and we end up sending two shipments while the carrier won’t repay us. Previous issues pertinent to this have made it necessary for us to come up with this policy. You agree NOT to give us a negative feedback if such an incidence were to occur.
  • We make every effort necessary to make sure your order exists in our stock, but if an item is back ordered, we will inform you immediately.

Exchanges / Replacements:

Most products would not be affected with the exception of gauges, which may have differences in font, mph or tachometer settings. You agree to these terms by conducting the transaction.   • Returning products that are not ours is considered an act of fraud. Some products include hidden security devices that do not impact merchandise performance or appearance.
  • If a suitable replacement cannot be made within 3 weeks, your money will be refunded minus the shipping costs.
  • If we make an error and ship you the incorrect product we will replace the item after it has been shipped back to us. This does not happen often. We will only ship back once we receive the item, after inspecting it to make sure everything is in order.
